Terms and Conditions - Dropshipping of Saucony Products on https://upandrunning.co.uk/

The following additional terms and conditions apply when you purchase selected Saucony branded products within the drop shipment program via the Up & Running website. This is because the way in which we handle selected Saucony products differs from the way in which we sell the other products and brands available on our website.

Saucony means Wolverine Europe Retail Limited, registered in the United Kingdom under company number 6560355, at Kings Place, 90 York Way, London N1.

General Information

1.1 These terms and conditions ("Terms") govern the drop shipment of Saucony products ("Products") on the website https://upandrunning.co.uk/ ("Website") by Up and Running ("Retailer") to customers ("Customers") who purchase the Products through the Website.

1.2 By participating in the drop shipment program, Retailer and Customers agree to be bound by these Terms. Retailer reserves the right to modify these Terms at any time, and it is the responsibility of Customers to review and understand the most current version before placing an order.

Product Availability and Ordering Process

2.1 The availability of Products for drop shipment may vary and is subject to change without notice. Retailer will make reasonable efforts to ensure accurate and up-to-date product information on the Website.

2.2 Customers can place orders for Products through the Website. Retailer will process the orders and facilitate the drop shipment of the Products directly to the Customers.

2.3 Retailer reserves the right to cancel or refuse any order at its sole discretion, including, but not limited to, orders that violate these Terms or any applicable laws.

Pricing and Payment

3.1 The prices of the Products displayed on the Website are subject to change without notice. Retailer will make reasonable efforts to ensure the accuracy of pricing information but does not guarantee its accuracy.

3.2 Customers are responsible for paying the price listed on the Website at the time of purchase. All prices are exclusive of any applicable taxes, duties, or shipping charges, which will be added to the total order amount during the checkout process.

3.3 Retailer accepts various forms of payment as indicated on the Website. Customers agree to provide accurate and valid payment information and authorise Retailer to charge the designated payment method for the total order amount.

Shipping and Delivery

4.1 The delivery of Products will be managed by Saucony and not Up & Running. Saucony will be responsible for the delivery of the Products directly to the Customers. However, any delivery problems, returns and other customer service issues will be dealt with by Up & Running on behalf of Saucony. Only delivered within the UK, due to shipping restrictions.

4.2 Customers are responsible for providing accurate and complete shipping information. Retailer will not be liable for any delays or delivery issues arising from incorrect or incomplete shipping information provided by the Customers.

4.3 Retailer will use commercially reasonable efforts to ensure the Products are adequately packaged and shipped. However, Retailer shall not be liable for any damage, loss, or delay during transit or delivery caused by the shipping carrier or other circumstances beyond its control.

Returns and Refunds

5.1 Customers may be eligible for returns and refunds of Products in accordance with the Retailer's return policy, which can be found on the Website. Customers are responsible for reviewing and understanding the return policy before making a purchase.

5.2 Retailer reserves the right to refuse or deny returns and refunds if the returned Products do not meet the conditions specified in the return policy or if they are returned without prior authorisation.

7.3 Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Governing Law and Jurisdiction

8.1 These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of laws principles.

8.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
